Why Are Allergan Breast Implant Lawsuits Filed?

Allergan breast implant lawsuits are being filed due to findings that link Allergan’s textured implants to Anaplastic Large Cell Lymphoma (ALCL). ALCL is a rare type of cancer that develops in the tissue surrounding the implant. The U.S. Food and Drug Administration has received hundreds of reports linking Allergan implants to ALCL.

WHO classification

In 2016, the World Health Organization officially classified BIA-ALCL as a type of T-cell lymphoma. In December 2018, the sale of textured Allergan breast implants was halted in 33 European countries.

In May 2019, Health Canada suspended Allergan’s license for BIOCELL breast implants after an internal safety review found that they posed an elevated risk of developing ALCL.

FDA study

2020 update

As of January 5, 2020, the FDA had received 733 cases of anaplastic large cell lymphoma related to breast implants. Among these reports, 85% (620 cases) involved Allergan breast implants, 9% (66 cases) involved implants produced by Mentor, Sientra, and other companies, and 6% (47 cases) did not specify the manufacturer of the implant. Further, these reports of BIA-ALCL included 36 deaths.

In summary, the median duration from implantation to diagnosis of ALCL is eight years.

2021 update

There are currently several class-action lawsuits pending for victims of defective breast implants and as of April 2021, 602 individual cases have been consolidated into multidistrict litigation taking place in United States District Court in New Jersey.

2019 update

In July 2019, Allergan announced a voluntary recall of their textured breast implants, shortly after the FDA requested the recall. Interestingly, this decision came after the FDA reported 573 global cases of BIA-ALCL.

Also, of those cases, 33 resulted in death, with 12 of them involving Allergan’s implants. The remaining cases involved unknown manufacturers.

Further, the FDA also noted that Allergan’s textured implants were six times more likely to cause BIA-ALCL than other textured implants. 

In response to the recall, Allergan offered affected individuals a replacement Biocell implant, $1,000 for diagnostic tests, and $7,500 for cancer surgery. However, many women who were harmed by these implants opted to file a lawsuit and are now part of the MDL class action. 

Currently, there have been no reported settlements between plaintiffs and defendants in these pending lawsuits. The parties are in active discussions toward a settlement.
