American tort law is fraught with largely unpublicised problems, particularly in mass torts, which typically involve corporations and many individuals alleging harm from a single source. Shockingly, less than 10% of victims file claims, with many remaining unnoticed or uncompensated, and compensation is often uneven. Over the last 20 years, the Environmental Protection Agency (EPA) has handled over 3,500 mass tort claims. On average, a case lasts 7 years and total payouts are in the tens of billions. With more than 100,000 mass tort cases filed in 2020 alone, the financial and societal burdens are formidable. It is hoped that lessons from past mass torts will create a more fair and just system.
